Dental Implant Guarantee:
We stand behind our work and we exceed ADA guidelines with our Guarantee* on dental implants. GETAWAY Dental will replace dental implant at no additional charge, in cases where there has been no osseointegration or where osseointegration has failed.
The Lifetime Guarantee is void if the failure is caused by a trauma, an accident, or by any other damage caused by the patient or a third party; or the failure is caused by a clinical component placed in patients with accepted contra-indicated conditions to successful implant integration, including but not limited to diseases related to alcoholism, uncontrolled diabetes, and habitual drug dependency; or the implant subject to warranty claims has been used in direct or indirect combination with a clinical component or instrument originating from another dental provider other than GETAWAY Dental.
One Year Guarantee on Crowns, Bridges & Restorations:
GETAWAY Dental will repair or replace without charge to Patient any Covered Treatment that fails due to faulty materials or workmanship.
TREATMENTS ELIGIBLE FOR COVERAGE: The following types of treatments are eligible for coverage under this Limited One-year Warranty Agreement: Crowns, Buildups, Posts, Bridges, Inlays, Onlays, Abutments and Implant Crowns.
HOW TO OBTAIN CARE AND SERVICE: In the event of a failure of a Covered Treatment, Patient must notify GETAWAY Dental of the failure within a reasonable time after discovery (not to exceed 7 days) and schedule and attend an appointment with GETAWAY Dental to take or schedule corrective action. Patient’s failure to timely notify GETAWAY Dental of a failure is grounds for voiding coverage.
TERM: Coverage of Covered Treatments begins on the Treatment Date
WHAT IS NOT COVERED: This Limited Warranty Agreement does not cover: Preexisting conditions, Bruxism, Cosmetic discoloration, failure of a Covered Treatment due to: failure of Patient to comply with his or her Patient Responsibilities, other treatments, medical conditions resulting from substance abuse, medical conditions that cause damage to oral structures including the supporting bone around implants, loss of a removable prosthetic or appliance.
PATIENT RESPONSIBILITIES: Patient is responsible for routine dental care and proper oral and dental hygiene. Failure to receive routine dental care and proper oral and dental hygiene will void coverage. Smoking, drug use and other abusive habits will also void coverage. Patient is responsible for providing proof of routine dental care.
WARRANTY DISCLAIMER / REMEDY LIMITATION / DAMAGES
EXCLUSION: This Limited Warranty Agreement is a complete statement of GETAWAY Dental’s warranty obligations. GETAWAY Dental makes no other warranties, written or express. Unless prohibited by the governing law, all implied warranties, including any implied warranties of merchantability and fitness are excluded. Patient’s sole recovery from breach of this Limited Warranty or any implied warranty shall be damages in an amount not to exceed the total Treatment Cost, that is, the amount paid to GETAWAY Dental for treatment. In no event shall GETAWAY Dental be liable for incidental or consequential damages including travel expenses.
OTHER AVAILABLE COVERAGE: GGETAWAYoodness Dental reserves the right to require Patient to submit claims on Covered Treatment(s) under any available insurance or other medical or accidental health benefit programs prior to obtaining service under this Limited Warranty Agreement.
ARBITRATION: Any and all disputes, claims, differences, disputes or controversies arising out of or in relation to any aspect of this Agreement, its business matter, performance, liquidation, interpretation, validity or any breach thereof, shall be resolved by arbitration in accordance with the bylaws of the International Center for Conciliation and Arbitration of the Costa Rican-American Chamber of Commerce (“CICA”). The parties hereby agree to submit voluntarily and unconditionally to its rules and bylaws and claim knowledge thereof. THIS LIMITED WARRANTY IS NOT AN INSURANCE POLICY.
Modification or Withdrawal of the Guarantee:
GETAWAY Dental reserves the right to modify or withdraw this Guarantee at any time without notice.
